Blood Alcohol Content is a measurement analyzing the percentage of your blood that is concentrated with alcohol. Georgia drivers with a BAC of .08 or greater are automatically charged with DUI. However, even if a driver’s BAC is lower than .08, yet he or she is not impaired, they may still be charged.
A DUI, or driving under the influence, refers to a situation where someone operates a vehicle after consuming alcohol or drugs (including prescription drugs) which causes them to become impaired. Similarly, a DWI (driving while intoxicated) exclusively describes a driver who has been consuming alcohol. While some states differentiate between the two charges, Georgia does not; and currently classifies a DUI as a misdemeanor.
A typical field sobriety test usually includes one or all of the following: the One-Leg Stand, the Walk and Turn, and the Horizontal Gaze Nystagmus. Officers may also ask those suspected of drunk driving to perform a breathalyzer test or provide a sample of blood.
